Dear John…

Interesting post, EKG. It’s nice to see the left has found a new target for its vitriol now that George W. Bush is out of the picture.

I’m sure Palin-bashing is a pleasant distraction from President Obama’s serial failures. At the very least, hatred for her has provided the faithful with a rallying point.

I ignored his glossing over of President Obama being a target of vitriol himself and  asked him to enumerate Obama’s ’serial failures’.  His reply was

Failure to get his health care bill and Waxman/Markey passed, even with total Democratic control of Congress; extraordinarily high unemployment rates; a rapidly rising deficit (over and above what was “inherited”); failure to close Guantanamo; take your pick. You can throw in failure to secure the Olympics for Chicago and declining poll numbers too.

as I started to answer him, I realized that these questions and answers deserve more space than the comments section of another blog-post. So I decided to answer them here….

First off, John.. I don’t know you. I don’t know if you are an extreme right winger, I don’t know if you are unbend-able in your opinions, I don’t know if you tow the party line no matter where it takes you. I know you are a friend of Mike’s, but I don’t know if you are as obstinately against looking at things from another perspective as he is or not. Because of this… uncertainty, I am answering with the assumption that you can see a different way of viewing things if shown, or explained.. I’m assuming that you are moderate and not hard-extreme like Mike.

No one likes to be blamed and no one likes their party to be blamed… but no one likes the other party to actually be at fault and share none of the blame and instead pile it all on one side. Of course I am going to place blame with the GOP on many issues, what I will wait to see from your reply to this is if you can see why I would blame them.. maybe not that you agree that they are to blame for alot of it, but maybe..hopefully.. you will admit that they do share, alot, in what is going on today. This is not a ‘well he did it first’ kind of blame. I believe I am laying out a valid argument. I hope to get more than “well you did it first” or the condescending  “LOL” and  “eyerolls” from you in your reply.

Now, on with the blog.

I agree with you John, it is Obama’s failure that Health reform has stagnated. He took it on faith that when Grassley, Snowe and other (R) said they were willing to work on a bi-partisan  solution,they meant it. The rest of us were hearing Grassley call it a ‘death panel’ and how people should fear Obama’s health reform and how he’d never vote for it when he was home on the weekends, but the ‘bubble’ Obama lives in, the same that all Presidents live in, prevented him from hearing that “weekend, rally the base” talk.

I don’t think it was until Lieberman’s extreme, blatant and almost joyful bragging of this ‘partisan ‘obstruction’ that Obama finally wised up. When Lieberman, who just a few years ago ran on his “medcare for 55″ policy and was saying everywhere he could that this was the only solution he would support…immediately turned against it because, as he  said,  ‘well since liberals like my plan, I’m against it now’,  I think the President started seeing what he was up against, and what he was up against was illogical and unreasonable opposition. Do you atleast agree that Lieberman’s flip on his own idea and the reason he gave, prove this illogical and unreasonable position?

Even if you don’t think it was illogical or unreasonable, how can you fault President Obama for not getting things done in that kind of atmosphere? We aren’t talking about anything rational that can be explained or even expected. Republicans  and that includes Lieberman(I), were turning on their own plans, things they had campaigned on, the second after President Obama said “Hey, you know what.. your way does sound better so let’s include it”

The CBO – which provides the official estimates of the budgetary impact of legislation and events such as wars and recessions – cites the housing market collapse and the financial market turmoil as the main culprits for the shortfall. The federal government has tried to combat the crisis by so far committing $7.2 trillion in investments and loans primarily to financial institutions.

The current recession “will probably be the longest and the deepest since World War II,” the CBO said. The economic deterioration since September, which was the last time CBO made deficit projections, is the biggest contributor to a sharp decline in tax revenue projections. The CBO expects tax revenue in 2009 to fall by $166 billion, or 6.6%, from the previous year’s collection.

That revenue decline, in turn, is the biggest reason for the worsening outlook over the next decade, said Diane Lim Rogers, chief economist at the Concord Coalition, a deficit watchdog group. “The revenue effect is huge.”

and Obama does own his own share.. But we know that he does not ‘own’ the entire  problem. Why is it then that he is saddled with it? Where was this outcry of ‘budget deficits’ going back 3 years and more? How is this President Obama’s doing? He added to what was there yes, but what was the alternative when he stepped into the Oval on day one? You and I along with McCain and so so many others, know that had he won, McCain would have had to do the same exact things Obama did and would have had the same exact deficit today.. This really isn’t an Obama issue.. we all know this but since it’s going on under his watch-he gets the blame..Ok fine, but then we do have to put blame on the person who did create it.  No, this isn’t a “he did it so I can to” this is a ‘I really had nothing to do with all of it, so stop blaming it all on me argument and that is based in reality, not GOP partisan amnesia and fantasy.

When Obama stepped into office he had to deal with 2 unpaid wars, unpaid tax cuts, a wall street collapse, a housing market collapse, an infrastructure that had been neglected for 10 years. The Bush budget deficit projections never included the war price, when Obama put it into his, like it should have been done in the 1st place.. it didn’t help his numbers at all, but atleast it was honest. Unlike those who are supposed to give us ‘fair and balanced’ news..

During the April 3 edition of Fox News’ America’s Newsroom, on-screen text repeatedly falsely claimed that President Obama’s $3.6 trillion fiscal year 2010 budget is “4x bigger than Bush’s costliest plan.” However, President Bush submitted a $3.1 trillion budget for FY 2009. For FY 2008, Bush submitted a $2.9 trillion budget.

But Obama deserves the blame for all this hiding, collapse and the unpaid bills that all came due just a few short days before he came into office? Which turned out to be more than anyone.. anyone ever expected as more came to light in the coming days after his inauguration? If you truly feel this blames lays on President Obama’s lap, can you explain how you came to that decision?

High unemployment

Yes.. there is.. but you can’t look at 700,000 jobs lost per month when he got there to 11,000 in December 2009 and call that a failure.. and you can’t look at the numbers we were at, are still at now and expect it to change the next day.. or even the next year, not if you’re also not going to allow a larger stimulus bill/recovery act. So Obama was wrong on his optimism those 1st days that the unemployment numbers wouldn’t rise past a certain level, fine. But is he to blame that the numbers rose to that level or just to blame for not realizing just how bad things were a split second after he got there?

Is it the loss of jobs you blame him for or the bad prediction on jobs lost?

Like it, love it, hate it… when no one else is spending any money… the government has to. For the Government to also stop spending money is a catastrophe on a scale that we’ve never seen before. When no one, banks, businesses,people on the street are spending anything.. the government has to. It has to beg,borrow and yes, steal to spend money in order to get people spending money spending again. McCain,Romney,Huckabee.. Reagan.. all would have had no choice, given the exact same circumstance,  but to do the same. Or they would have watched while the country crumbled into oblivion the way Nero did. The ones like Mike, who argue that no, the government shouldn’t have spent a penny, can’t prove that their way would have been the right way or that we’d be any better off. They can’t prove it because there isn’t a time machine to take us back. So to me this argument is one of pure partisan fantasy. It cannot be proven and yet the GOP swears their way was the correct way. What’s worse is, they make 1/2 the country believe in this unprovable feary-tale. This is where the ‘faith’ and almost ‘religious like’ belief comes into play and it is the cornerstone of a lot of the GOP’s argument..

You can’t prove God doesn’t exist therefore he must be real.

They can’t prove no stimulus or Tarp would have worked better, therefore it must be true.

I call bullshit on both accounts… You want me to believe we shouldn’t have spent the money on the banks and on the recovery act, then prove it to me. Prove to me that not spending it would have worked better, that we would be in a better place, telling me  you are right only because you say so doesn’t work, I am not a believer in your religion I need more proof than that.

By the way, John.. Most of the “YOU” I use are not directed at YOU.. it is a general term used when speaking. I  hope you understand that.

Failure to secure the Olympics?

Are you kidding? 1/2 the country didn’t want the Olympics

Forty-three percent (43%) of Americans say it’s a bad idea for President Obama to go overseas at this time to help Chicago make its final presentation to the International Olympic Committee

John Boehner blasted the President for trying to get them

“Listen I think it’s a great idea to promote Chicago but he’s the president of the United States, not the mayor of Chicago,” Boehner said. “And the problems we have here at home affect all Americans and that’s where his attention ought to be.”

and every night they were rewarded with their opinions by the likes of the GOP and Fox news telling them how bad it would crush us, how much money it would take, how horrible it would be. How dangerous Chicago is

Yes, Fox news is a factor when they have the massive viewer ratings they have, add them into Rush’s 20 million people a week rating and all of them chiming in on the evil that is the Olympics and why would we get it over a country literally begging to have to it because they want it?

But ok, Obama didn’t get the Olympics… that’s a failure on his part. But is that really something to hold against him? out of everything… is that an issue that truly pisses you off and just sticks in your craw?

Gitmo.

I’ve thought about this. Was Obama the naive one to think he could wave his ‘magic negro’ wand and close Gitmo? Or were we the naive ones to think he could wave his ‘magic negro’ wand and close Gitmo? I think it was both. I think a lot of us listened to his speeches and felt the inspiration and hope in that new era he talked about bringing. I think those of us who didn’t roll our eyes and didn’t decide that election night to do everything we possibly could to make his life hell and oppose everything.. everything he tried, actually believed this was the guy to change Rome back into the days of it’s purity,prosperity,glory and power. We (wrongly) assumed that Washington was also sick on the status quo, that Washington wanted to move on to a better place. That the country didn’t care if it was a Republican or Democrat, man or woman, black or white in office, we just wanted hope and change and not more of the same thing we had had for so long. We were all naive.

President Obama owns the failure to close Gitmo, but he doesn’t have sole ownership. Jesus, trust me I know it’s like a broken record to say the GOP also owns this since they stood in the way and did everything in the power to make sure 1/2 the country was against closing Gitmo and bringing the detainees here..but it is the truth. Through fear mongering and out right lies, GOP congressmen,governors,speakers,pundits went out to their communities , viewers, listeners and said “No way! Not in my yard, these guys are dangerous,these guys can’t be held in our prisons, these guys are super-powers that can only be controlled in Cuba” and we both know, hell we all know this is factually untrue. We are holding terrorists right now on our soil, we are holding terrorist right now in our prisons, we have been holding them for years. We are holding people who are worse! We, as Americans, have some of the most dangerous criminals in the world in our prisons right now. We have brain-eaters,baby-rapers,kidnappers,tortures,sex-slave traffickers ,abusers,bombers,pyromaniacs,serial killers, mass murders.. and we have extremely smart and devious   criminals like Madoff, Abramoff and hunderds of others. But somehow we’re ill equip to incarcerate men who have probably never had running water until they got to our prision camp?

That’s the most bogus of all feary-tales ever told. This idea that America is too weak, too incompetent and unable to imprison anyone is incredulous. If this is your belief, that we are just unable to rise to meet this ‘danger’ can you explain your reasoning to me, explain it without “Because they should be in a military tribunal”

All of this leads to a drop in polls.  You’ve seen the link to the numbers of Fox and just Rush, that doesn’t include Beck and all the other conservative radio. When  they are all, from top to bottom on the same line in the play book, all condemning,ridiculing, mocking, lying,inflating.. all giving out the worst of the wosrt bias,slanted partsian spin.. add that in with an entire section of Congress that doesn’t just stand in the way, but also makes up feary-tales and they believe it, polls are going to decline. How could they not?

And what about that anyway. Isn’t it normal for Presidential numbers to come back down to a reasonable level?

The other day I was reading the comments on a reputable news sources story about this Baradar capture, 75% of them were things like “Well, now that we can’t waterboard the guy the CIA will never get anything out him, Thanks Obama for ruining this country once again!” If the only tool in the CIA arsenal is waterboarding… then we really are fucked. Because it’s the opinion that begs the conclusion that the CIA has always and only water-boarded prisoners to get information and it was just the 2-3 years that they were legally allowed to that the were able to function at full capacity in the light of day. The point I’m making is, somehow people  think that CIA  doesn’t know how to get information from anyone without waterboarding them? Is this not the most insane thing you’ve ever seen? Why is this?Where did they get the idea that this was the only tool the CIA had? If  you can truthfully answer that, they you should be able to understand most, if not all of what it is I’m trying to show you.

Who is to blame for this? Not Obama.. but it is what he must fight against. The problem is you cannot argue with someone with that mindset. Their belief is again, religous like.. and cannot be changed,altered or enlightened.

Finally, I saved the best for last… “even with the democrats in control of congress”.. This is the most used response that I  see for pretty much everything. This idea that just because the Democrats had a filibuster  proof margine and didn’t use and some how it’s their fault is ridiculous . Listen, I’m going to tell you a secret that could get my liberal-card revoked ( :) )  unlike the GOP, there are different levels of (D). We don’t all think with one brain, we don’t all follow the leader like a flock of birds, that is what makes us ‘liberal’ or the favorite slam of the GOP, ‘radical’ . We think for ourselves and decide accordingly and not according to party/leader doctrine. We are just not that  ‘religious-like’ in our faith and the following of party ‘dogma’. There are Democrats who don’t believe in abortion, there are some like me who believe in the death penalty and guns rights. To condem anyone.. any party  for not just towing the party-line is asinine  and to blindly follow the party-line used to be a bad thing.. but today, with the entire GOP saying “You can’t even get your party to all vote the same way and use that fillibuster proof majority” is so exquisitely  sad, but still not as sad  wanting and forcing any one party to act that way. I just can’t believe anyone, anywhere would want and encourage people to just blindly vote all (D) or all (R) depending on their party and then ridcule and condem anyone when they didn’t.

Besides any of that, this isn’t a one party system, the other side is supposed to help govern also!

This excuse…“Hey, you guys control congress.. it’s not our fault” and those using it are right though, the problem is the next thing they say to their audience,readers,constituents… and the next thing is invariably

“The Democrats need to listen to the country and work bi-partisanly”

In one hand there is a dare to use the majority, in the other.. a crying to all who will listen that if we don’t do something…have rallies, write letters, send in campaign money.. the Democrats will use their majority. It’s insane! They are literally damned  for not using it by the GOP and some of their own and damned  if the think about using it.

So John, what would you have them do? Which ‘evil’ do the Democrats pick?  Do they follow in the last administrations path and issue Executive Orders, recess appointements, signing statements and push through everything the President says to push through no matter the consequence and just hope that the GOP won’t cry about it too much? Do they forget their own values and beliefs and just vote (D) all the way down the ballot like the GOP does and is encouraging, or really, daring them to do? What is your solution to this? When one party refuses to even come to the table don’t they force the other party to act as a single mind? Force the other party to do it all on their own, with their own philosophies?

Maybe the GOP is comfortable using a single-mind, but this is not and has never been the “Democratic” (party or poltical system.) way..

The GOP has blanketed the world with this falsehood that they want bi-partsanship on every issue, and yet just last week when invited to a health care summit, an ‘exachange of ideas’.. quite a few high ranking GOP’ers said they might be willing to come to the table…. just come to the table now, not vote a certain way or concede a certain point,  but they might show up to the President’s bipartisan effort for health reform meeting but only if the  Democrats dropped their health reform idea and adopted the GOP version. Eric Cantor flat out said that the “only way to bipartisan cooperation is if the Democrats fully embrace the GOP plan!” What? How is that bipartisan? How is that anything other than a great big “Screw you, It’s my way or no way and that’s the only bipartisan I agree with.. do it yourself if you don’t like it! Just remember I will blame you for doing it yourself if you do”

You cannot, as the losing party give that kind of demand.. that kind of close-fist demand.. and then claim you are the bipartisan party, yet they do, and no one calls them on it.  So I ask you once again, is this really an OBama failure and where is any ire at the party that is actually holding bipartsianship hostage?

To me President Obama failures are..

He has moved away from a public option. He promised me a public option and I believed him. He has let the message on this and so many other issues get away from him. He had the advantage and he expected to find ‘Statesmen’  and ‘Adults’ in congress who wouldn’t bastardize everything they could to score a political point and while he’s finally decided to come out swingng and get the truth out.. he’s wasted vaulable time and his ‘capitol’ in the interim.

I see it as a failure that he is still giving contracts to the likes of Blackwater and doing it even though we know they are the evil of all evil. Why do we need to privately fund any war with a bunch of mercenaries? Why do we need them for private security? Why can’t we use the money and build up our military and pay our troops more? Atleast they have rules,laws and codes they must follow. Blackwater and the likes do things with our money and in our names that I do not think the majoirty of us want done in our name. I do not agree at all with their continued government funding. Bring the military back to do the jobs in our name with the honor and integrity that they will bring with them.

I see President  Obama’s lack of authority with Wall Street as another failure. He needs to force those CEO’s to either get their sweet-ass to the proverbial ‘come to Jesus’ meeting.. or risk immediate stripping of the ‘handout, even if that means selling off part of the company to get back the money given to them. I don’t know who these people think they are, but when the President of the United States tells you to come to a meeting.. your sorry ‘hand-out-taking’ ass better get there before the ink is dry on the invitations. I don’t care if it was ‘foggy’ or not, take the damn train.

I don’t care about GOP crying that “OBama hates capitalism .. Obama is an enemy to buisness” because it’s  a load of crap, what we had leading up to this meltdown was not capitalism .. it was rape pure and simple. It’s time Obama starts acting like the President he is and do something about these guys.

And finally.. He has failed at installing a new way of doing it, he has failed at starting a new era of bi-partsianship.  He hasn’t failed for the lack of trying, he’s failed for the lack of realism. He believed he could change the climate of hate that is the US congress. Not a single congressman from either house or either party can say or do anything without checking a poll 1st. They are not there to govern like Obama is, they are there for the power and the paycheck. It is President Obama’s failure to not see this that irks me the most. It is his failure to not see that, no matter which way he goes the entire Right side will be against him as proven time and time again, even by adopting their own policies.. they will go against him. They will and have cut off their noses to spite their face.

President Obama is already lambasted as a socialist even when he’s cut taxes and wasn’t the one to create the largest ’socialist program’ in a generation or more. Well,  if they are going to call him one anyway, then why not use that and go more radical on his ideas. We just proved a lot of the country is pro-radical change, even our supreme court is. So it is a failure on Obama’s part not to use the gift he’s been given by the Right. He will be slaughtered and lied about by them no matter what he does.. so he might as well do as he wants.

John, thank you for your comments.. I hope I have addressed them in a way that maybe didn’t change your mind.. but atleast gave you a different point of view and a way to look at it

…without waterboarding?

Washington (CNN) — Senior Obama administration officials revealed late Tuesday they’ve secretly gained the cooperation of family members of Umar Farouk AbdulMutallab to help get the Christmas Day airline bomb suspect talking.
The cooperation effort has led to actionable intelligence that could help prevent terror attempts on U.S. soil, the senior officials said.

No torture, no waterboard,no stress positions,no violation of human rights or our own laws… and he’s actually talking and without a military tribunal to boot!


The senior administration officials said that since AbdulMutallab began talking to investigation again last week, he has been cooperating on a daily basis. The officials added the information gained from the interrogations has been disseminated throughout the intelligence community.

One of the senior Obama officials, who bluntly said the Republican attacks have “frustrated the hell out of me,” asserted that gaining the trust of the family was the best way to handle the case and helped the administration gain valuable intelligence from the suspect, who is believed to have ties to an al Qaeda affiliate in Yemen.

“It could be used to disrupt other attacks,” one of the senior Obama officials said of the intelligence gleaned from AbdulMutallab in the interrogations, who added the president has been getting regular updates on what the suspect has been revealing.

The Republican response so far is to complain that President Obama has wasted these 6 weeks, but let’s have some truth for once shall we…

U.S. military teams and intelligence agencies are deeply involved in secret joint operations with Yemeni troops who in the past six weeks have killed scores of people, among them six of 15 top leaders of a regional al-Qaeda affiliate, according to senior administration officials.

The operations, approved by President Obama and begun six weeks ago, involve several dozen troops from the U.S. military’s clandestine Joint Special Operations Command (JSOC), whose main mission is tracking and killing suspected terrorists. The American advisers do not take part in raids in Yemen, but help plan missions, develop tactics and provide weapons and munitions. Highly sensitive intelligence is being shared with the Yemeni forces, including electronic and video surveillance, as well as three-dimensional terrain maps and detailed analysis of the al-Qaeda network.

I know some were worried about AbdulMutallab being mirandized and like John McCain, were trying to attack for Eric Holder for his decision and I guess prosecute him for treason(ok, not the treason part-or are they) but it looks like they can put those feary-tales to bed.

“It is also my understanding that Mr. Abdulmutallab has provided valuable information. Is that correct?” Senate Intelligence Committee Chairman Dianne Feinstein asked.

“Yes,” Mueller replied.

Mueller then confirmed that the interrogation has continued despite the fact that the suspect had been advised of his right to have a lawyer and remain silent.

Now this is something I also found to be of interest

Since the terrorist attacks of Sept. 11, 2001, politicians and the courts have wrangled with the thorny question of how to treat suspected terrorists. The Supreme Court has not weighed in on whether the government has the right to hold a civilian as a military prisoner, and both times it appeared the court would get the chance to decide, President George W. Bush opted instead to bring the cases in civilian criminal courts

George Bush was hard on terror; he, Dick Cheney and those like them are the only ones who can keep us safe. President Obama, following their plan makes us look weak to our enemies though and thus makes us more vulnerable to attacks. How does that work?

The fact is we have a 100% success rate in trying terrorists in civilian court and as far as I know the only ones walking around and back to their old tricks, are walking around because Dick Cheney released them! We’ve killed or captured more terrorist leaders under Obama’s 1st year than we did in the last year of Bush. We’ve had more ‘drone-launched missile strikes’ in President Obama’s 1st year than in Bush’s last 3 years. We are spending more money to “expand secretive Special Operations units, deploy more unmanned aerial drones” , but somehow it’s not good enough because President OBama doesn’t torture, because he doesn’t throw everyone into a military tribunal, because he  treats people as the laws this country was founded on tell him to treat people, so  he is still weak on terrorism. If anything, the increased drones attacks,increased terrorist casualties, successful interrogation of a  terrorist should prove that not only is he not weak on terrorism, but that he’s doing something pretty right.

Alas… like the elusive Osama Bin Laden tape that surfaces only after some major event has happened, I expect a carefully worded press release from the most elusive of all creatures, Dick Cheney. Fox news and the conservative blogosphere need something to come after Mr. Obama on since he ate them for lunch at the GOP retreat last week, coupled with this new information on the lack of torturing actually working and Cheney is probably being roused from his slumber now.

I don’t expect anyone from  the right to commend the President for a job well done,that would be ridiculous and let’s face it, the halfhearted attempt would come out more condescending than anything else. The GOP for all it’s glory has painted themselves into a corner. In their quest to dismiss this President, they have painted him as a weak, incompetent, unintelligent, lying, dangerous,socialistic,Nazi-like, thief looking to steal your money to give it to the poor and your guns to give them to the Muslims.  I’m sure there is something to nit-pick about and if not, they can take a page out of a GOP strategists memo and just lie, but I thought this was a pretty good job of getting the guy to talk without having to drown him 1st.

“ClimateGate?” Not so fast…

“Not so fast, let’s see what we’ve got here..,”

I think that’s been the request of everyone over the last few weeks when it comes to ‘climategate’. Well, everyone except every conservative on the planet. To them this was Christmas morning and they were foolish children who could not wait another second to open their presents. Conservatives like Sen Inhofe who thinks that global warming is grand hoax, rejoiced a these emails because now global warming is over and done, that they won and we lost and those who believed it can get a ‘real life’.Yes, the world got together and conspired to perpetuate this hoax upon the entire world so Al Gore could get an Oscar and to make George Bush look bad.

Ok, that’s silly. I really don’t know why the world would want to create this ‘hoax’  that we as human race were hurting the planet, much less know how a conspiracy of this magnitude could be kept secret; but that’s obviously what happened if you listen to the conservative media and conservative bloggers like my friend Lil Mike.

When the news of the emails broke, there was an outcry from the conservative mainstream media that liberal news wasn’t covering the story. It took Jon Stewart about 30 seconds to disprove this theory, but if there’s one thing we know about today’s conservatives it’s that they don’t want to be held to a standard of truth themselves, they just want to hold everyone else to an impeachable standard. Wow, you mean global warming is a hoax because it got cold in winter time? Well, I’m convinced…or I would be if I was a conservative. But I’m not and it’s not because I have some kind of agenda. In my opinion global warming is a bummer. Not only because of the effects on the planet but also because of the effects on my lifestyle. I enjoy all my electrical amenities, my small SUV, my virgin toilet paper and my beef.  So global warming is an inconvenience to my personal lifestyle and I would love to bury my head in the sand and forget about it. But living on the east coast of Florida and seeing the increased numbers,frequency and sheer size of some of the last few hurricane  not to mention the heat? Holy shit, this past June was the hottest we’ve have… ever, and  it’s 10 days before Christmas and we’re still having almost 90 degree temperatures.  So no, I can’t afford to ignore something of this nature because like it or not, this has been the hottest decade recorded.

Back to the emails. It wasn’t a ‘liberal’ media conspiracy to hide the news of the stolen emails, it was an effort to say “Hold on a second, lets see what we have here before we get all weepy with joy at catching someone red-handed”, you would think atleast Sarah Palin would have been on the side of those showing restraint. Since she’s condemned the media for making things up ,you’d think she’d want them to get it right.. But this kind of story is like crack to a crackhead, so of course the conservative mainstream media was jonesing to exploit,misrepresent, and bastardize it.

Thankfully we have real journalist who did wait, who did investigate and who did not jump on the tea-bagging bandwagon..

However, the exchanges don’t undercut the vast body of evidence showing the world is warming because of man-made greenhouse gas emissions.



Yes Virginia, 5 reporters and seven experts in research ethics, climate science and science policy have weighed in and it’s not global warming that’s bunk, it’s the believers and pushers of ‘Climate-gate’ who have been found wanting. But even knowing this, will the  vast conservative media network still shill for the oil companies and play to their ‘drill baby drill’ base?  You Betcha!

The fear of a healthy America…

There is a great discussion going on on the muchedumbre forum..

“Fear here… I got fear here… 1 trillion dollars… get your fear…

sorry, 900 billion… like any of us really know the difference…

So, is Obama simply repeating the mistakes of Bush II by selling important things to the American people with fear?

fear here, fear now.. we must stop it.

Well, we must stop it when it is President Obama doing the mongering, when it is a Democrat’s agenda, when it is an issue that 70% of the country’s population want.

We are being led to believe that the ‘fear’ the President it ‘mongering’ on the rise of insurance prices, the crippling effect that the uninsured have on the medical system, and the eventual crash of medicare/medicaid  is just fanciful and over-the-top unnecessary rhetoric. But this isn’t about the country, this isn’t about helping the 70% majority get what they are begging for,the Republican’s  only goal here is to stop Obama by ending his hope of healthcare for everyone. The idea behind  stopping the healthcare reform the President is asking for is that it will  bring his popularity down enough for Republicans to  hope for a chance to win a majority of congressional elections is 2010. This isn’t about you or me to the Republicans, this is about beating Obama and winning congressional seats. Just ask Sen. James Inhofe (R-OK). He isn’t afraid to admit the Republican agenda.

“When you tell people that the mortality rate in Canada is 25% higher for breast cancer, 18% higher for prostate cancer, you know, they say why in the world would we emulate a system like that?”

Of course they are telling them a lie, because that is not the system we are trying to emulate.. but what good is a little truth when your goal is fear. Why bother with the truth when the  the mortality rate for mortality is 3% higher in the United States than Canada? Because then, you lose your argument all together.

This idea of pretending that our healthcare system would suffer or the bonus-cuts the poor and destitute health insurance CEO’s would have to endure are not the issue, is ridiculous. The issue is to do what it takes to win at all costs.

The majority of us who support a public plan and are willing to pay for it, are sadly not as important as those who donate millions to coffers of our elected officials both Democrat and Republican. Oddly enough, the ones taking the most money from Phamra and Big Insurance are the one blocking reform by calling for bi-partisanship. Which in this case means a bill so watered down and useless that it will do more harm than good. And yet to call them on this, to explain the immediate need for reform, to try and give a democracy what it’s demanding.. is to be out there ‘fear mongering’ and scaring the public and this just isn’t to be born!

We had to wire-tap our own citizens for fear that the terrorists were  making covert plans over the wires.

We had to torture  subjects who were captured for fear that they might  know something. In order to do that though, we had to change the wording of strict Geneva convention guidelines to change these POW’s into ‘enemy combatant’ for fear that the laws may protect them.

We had to detain  combatants  in secret holding facilities all over the world for fear that they would escape or worse, join together and become a ’super-terrorist cell’.

We could not try these combatants  in our own courts on our own soil for fear that they would  get off and be released into the population and begin collaborating with one another on another attack.

We could not house these combatants in our own maximum security prison system for fear that they may do what no one else has done, and escape.. or for fear that they would join in with the other extremely dangerous inmates housed with them and created new terrorists  networks.

We were even told to vote for the Republicans because they tried  to make us fear that they were the only one capable of keeping us safe in these uncertain times.

It’s telling that when these issue were brought up and the fear mongering was pointed at as an unnecessary tactic, he reply from the same people complaining about the supposed fear mongering President Obama is spreading, was

“So the Prez tells you stuff that you don’t like and don’t want to hear, and for his trouble of actually treating you like an adult and not sugar coating it, you call it “fear mongering.”

or

It’s legitimate and warrants some extra consideration.

That’s almost as “fair” as the people deciding the fate of the health reform being recipients of millions of dollars from the insurance companies… but not quite.

The scary idea that some Republicans are trying to make into some kind of truth, that once this reform is enacted, our elderly will be put out to pasture, is some of the most ridiculous and preposterous yet to be voiced in this debate. In country where a doctor is criminally punished for aiding terminal patients with only hours to live in excruciating pain, it’s asinine to believe that we would all of a sudden kill off an entire segment of our population. But fear is what the Republicans peddle to get their way, even if their way goes against what 72% of the population and 50% of their constituents are asking for.

The scariest part of all.. is that we and the Democrats in Congress will let them get away with it.

The only thing there is to fear here is the money Republicans and some Democrats will lose from the Health sector if they don’t get out and pimp for them now.

Oh…and to the Republicans who complain that bureaucrats should not be involved in the decisions between a doctor and patient, first I ask, is the  17 year old high school student working after school and weekends at the insurance call center denying  the care your physician is asking for now, doing that job any better?.. and then I say to those crying a whoa is me over politicians not being a deciding factor in the doctor/patient conversation.. Thank You for joining the ‘Pro-choice’ movement, the ‘Pro-medicinal marijuana’ movement and the ‘pro-assisted suicide’ movement, can we count on your support in 2010?

Why is it wrong or controversial for the President to add his own paragraph to an intelligence briefing?

In another discussion with Lil Mike, I’ve come to realize that I just talk to freaking much-LOL.. But seriously, it struck me that if he doesn’t understand.. then maybe others don’t see the big deal either, and that scares me. If we could for once.. just once take the political party out of the equation and base our verdict on the facts, I don’t think any of us would see things differently..  But we can’t take the (R) and the (D) out of the equation because then our entire world crumbles when we find out we’ve been duped and in the end supported a lie. Where we should be angry at the one who made us into the fool, we are angry at ourselves and not many of us like the idea that we were taken for a ride. It’s why ponzie schemes work so well.. Who wants to admit that they really believed the 40% return they were promised was real and legal..

In it, I talk about the mess we find ourselves in today, the news that the Investigators General found that the White House inserted it’s own wording into a threat assessment from the CIA and then used that paragraph to enact an unconstitutional doctrine..

To explain it more would take to much space and this reply isn’t about the paragraph as much as it’s about how that deceitful act is more detrimental to the principals this country was build on.. Life,Liberty and the pursuit of Happiness then anything we’ve seen so far.

Once again, my reply to Mike..

“That[inserting of the paragraph] opens a whole can of worms, but the actual paragraph, I don’t find a lie or contraversal. Do you? How would that change anything?”

The easiest 1st.. How does it change anything? If the White House is allowed to make up what they want, to get what they want.. how does that NOT change anything?  Please explain how you support any President doing this? Because I think you are slowly realizing that just because we had an (R) President for awhile, doesn’t mean we will always have an (R) president, we will eventually get a (D) and you can’t be ok with allowing this to continue when a (D) has the precedent..

But more than that… where do you draw the line?  The President can make up what he wants for security reasons that hamper constitutional rights… he can hold false PC hearings that tell us the ‘news’ he wants us to hear… he can use ‘plants’ to steer the topics of real PC’s to the direction he wants..   where do you draw the line? You don’t like the MSM being liberal, but you’re ok with the complete fabrication coming from your oval office?

Now the other part of your justification…that you don’t find it a lie… How do you know this paragraph is true? Because  it fits in with your opinion?

Had it been true (or a true threat) the CIA would have put it in there right? But they didn’t find anything like that so, the White House made it up.. at that time atleast, you were made to believe a falsehood that the Oval office told you.. and worse than that.. that falsehood was then used to convince you the NSA program (and so many others just because of the butterfly effect-) was needed, because that statement saying it was needed, was also inserted falsely..

In this instant, I won’t make your head swim at how much of a can of worms it is because I don’t think you would ever acknowledge it.. but in this instant, you..we were hoodwinked.

Bush/Cheney wanted the NSA program.. we’ll leave off the ulterior motives for that right now and just stick to that.. They wanted it and asked the CIA to give them a reason.. The CIA did what it was supposed to do, it investigated and put together a threat assessment.But, it wasn’t threatening enough to get Bush/Cheney what they wanted so they made up their own assessment and then used what they made up to bring to Congress and the American ppl to get that NSA program..

I really can’t believe you don’t see the implications of this. I don’t care whats going on in the world.. a President of the United States cannot make up a story, attach the CIA’s name to that story… and then steal rights from the citizens of the country because of that story.. That’s not what this country is build upon!

I won’t get into the problems this creates for the CIA… but take a minute and think about that…

Let’s look at the broad implications.. If, as you say, the paragraph was true then how can anything from the CIA ever be useful again? If they can’t get the threat right,  and it takes someone from the White House..(and we both know there might be 2 people in the White House who would know as much as the CIA on any given intelligence assessments)..but if it takes someone from the White House to see the real threats and tell people about it, then how do we believe anything from our intelligence division again? How can we trust their competence?

Ask yourself this, if it was so true, why didn’t they(the White House) put that paragraph out there themselves? Why did they attach it to  the CIA’s briefing. They had to have some intelligence from somewhere saying these things right? So why did they have to put it in a CIA memo? Why didn’t they make the intelligence division who gave them  the information, put out their own memo? Who was that intelligence division anyway and why are they to be believed over the CIA?

Or did the White House just make it up?

You can’t ignore those scenarios because they are the only two that exist.

Let’s go farther..
You will admit that the NSA program is a massive invasion of privacy.. one that, in your opinion is needed though..-yes?  Well, now you’ve just been told that the CIA did not find  reason enough for it and  the President made up a reason on his own and stole privacy from the American people.. your reason for it was made up! You may have felt there was a good reason, you may have been happy that the CIA report backed you up.. but the truth is, it didn’t!  I may love the idea that a chocolate diet helps me lose weight, but I can’t write my own little paragraph and insert it into Jenny Craig’s website saying it..

Bring this down to an easier level. You’ve been accused of killing someone. The local PD gets involved and investigates you, sure you look guilty and you probably did do it, but while everything looks bad against you, there really isn’t much to report. At an internal briefing on the status of your case the DA says.. Ok, well I want this guy wire-tapped.. The cops say, “well..we do too, but we can’t find a reason for it” .. So the DA decides to write a paragraph that does implicate you, it’s not  based on anyting he’s been told-he just makes it up on the spot and he hands it to the cops and says.. “Now go get your wire-tap. The cops go to a judge and say “Judge, read this paragraph right here, that’s why we need this wire-tap” and the judge says “Ok”..

Is this legal? and more than that..is that what you are saying you are happy to go along with in this country..

Is this what you want your President to do and will you ignore it now that you know what he did?

Is this the level of power you wish to give to the already most power office in the world?

If you want to allow a President and Vice President to arbitrarily make up their own reasons to do things that are unconstitutional…then why are you fighting government run health care.. why are you fighting government   run anything?

You didn’t’ serve this country for the last 25 years to allow your president to make up a fantasy to get something he wanted..did you?

I know this is difficult.. because to admit this opens a can of worms that could devour a country. You wouldn’t believe a liar who lied to you, or a thief who stole from you in your personal life.. but to believe this?  Wouldn’t this alone make you question.. What else did they do this on?

and I think that is why you will ignore this as a problem, because the  answer to that.. is something you don’t want to know..

Let’s face it, larger picture is extremely  frightening.How many other times did this happen? Besides just the NSA program, what other things did the White House insert it’s own wording into and then use that wording to get their way on… Is it possible it’s all been a lie or based on a lie? and what do we do about it? To investigate further might tell us the scariest truth we’ve ever dreamed up.. but to ignore it–well, that blesses every President from now until we resemble Russia Circa Stalin, which on that path, would be in our lifetime.

This can’t be what you and thousands of others like you served their country for..your oath didn’t say to protect the President when he lies to get his way-even if you agree with that way… did it?

It always seems like there is something in an (R) and (D) psyche that is almost like they feel if they acknowledge this.. like a house of cards, the whole thing will crumble. But if that house of cards is an illusion built on a lie, why would you want it to stand in the 1st place?

Where is your anger over what was done in your name?

Where is the line? Would it be OK for the Oval Office to make up a threat assessment with the intelligence community’s name on it, that says we must nuke a rival country and then go out on every “Meet the Press” tv show that will have them and promote this insertion?

Where does your tolerance end?

You’d think with months of screaming, ranting,crying, and those  tea-parties, someone would have mentioned that we are now  ‘less Socialistic’ …

If I could stomach listening to Boss Limbaugh, I would see if he was sweating and dancing to the tune of Beck’s  “Loser”. Since President Obama has most certainly failed in his attempt to turn the USA into the county of the New National Socialist Party,  with his ingenious take over of the banks and car companies.. whilst driving the rest of the country into the shittier by stealing our wealth and spreading it amongst the elites…

BB&T repays TARP money

Seven months after it accepted $3.1 billion from the federal government, BB&T Corp. – a longtime opponent of big government – repaid the money with interest Wednesday.

$93 million in profit was made off that investment.. Not too shabby in my opinion.

In fact, if it had not been for the ‘mo..and the 2nd story I never would have known that American Express, Bank of New York Mellon, Capital One, Goldman Sachs, JPMorgan Chase, Morgan Stanley, Northern Trust, State Street and U.S. Bancorp also announced that they had repaid their loans from TARP, or the Troubled Asset Relief Program.

I should be surprised that I haven’t heard anything from the biased and untrue liberal MSM.. right?

Then again, if the media really was a ‘liberal slanted monster’ this would be on every headline news crawler and program just to rub it in to the faces of the Chicken Littles who were screaming that we were being taken over by our government…ironically while ignoring that were already  ‘taken over’ by our government..

I guess they are moving on to make more accusation about the Democrats evil attempt to bring socialism to the shores of the country by giving every baby born, house cleaner working, and any one else who likes to choose things for themselves instead of having someone else choose for them, that deplorable option of…. Health Care. So like everything else we’ve seen ignored in the last week.. Chrysler’s repayment will go unnoticed because it’s easier to keep throwing the kitchen sink of accusations than it is to actually give it a minute to see if it just might work.. It’s more patriotic to wish failure for the Government attempt to stop the slide into another depression era than it is to say “OK, that was my bad.. Carry on”.

Anyway, thank you for the $93 million in profit BB&T.. it was a pleasure doing business with you.. Come again soon.

The special powers an (R) next to your name gives you…

A woman goes missing on Christmas eve, she is 8 months pregnant and due to attend a party later that evening. Her husband is 90 miles away fishing, it’s also found out that he had been having an affair and had told his mistress that he ‘lost’ his wife. Months later, the wife’s body, along with that of her unborn fetus is found on the shores of the area where the husband was fishing that day. After an extensive search and investigation, no evidence of even a crime is found…Is the husband guilty?

A teenager on vacation goes missing after a night of extreme partying. She is last seen getting into a car with 3 men unknown to those who had been on vacation with her. An extensive search and investigation produced nothing but a tome of lies from the 3 men, one eventually admits to being with the teen on the beach but says he just left her there and went home. She is never seen again… are the 3 men guilty?

A child is found to be missing a month after the mother last saw her, the mother never considered alerting anyone to this fact even though she claimed to be sure the child had been kidnapped.  During that month the mother partied heavily like she didn’t have  a care in the world. After an extensive search and investigation, and 1000’s of lies told by the mother, the body of the child was found near the mothers home….is the mother guilty?

After years of misleading us for the reasons of ‘national security’ a President is found to have also misled  Congress and implicated the CIA as an accessory to these ‘misleadings’.

A Vice Presidents orders the CIA to shut out top ranking Congressional members on a top secret surveillance program that a new Head of the CIA is aghast to discover. He subsequently orders a full disclosure of this program to members of Congress and an end to said program.

“The constitutional authority and responsibility for congressional
oversight is gone,”-Sen. Arlen Specter

A president wants certain powers to be extended to him to use at his leisure and asks his Attorney General to approve it. The Attorney General is in the hospital, sedated from surgery he had only moments prior, but this doesn’t stop the President from sending henchmen to the bedside of the Attorney General to try and coerce him into signing off on this law. The Attorney General refuses this order from the President because the law is unconstitutional and therefore illegal, and to allow the President to use these guidelines makes him an accessory to the crime. Instead of listening to his Attorney General, the President then has one of the henchmen from the hospital room, his “In House” counsel, approve the tactic over the refusal of the Attorney General and acting Attorney General. The Attorney General later resigns to spend more time with his family and the White House counsel is re-paid for his efforts that night by being raised to the level of Attorney General.

A security briefing memo is constructed by the CIA after tireless hours of investigation and hard work. The memo isn’t as ‘threatening’ as someone in the White House wish it would be so this person adds their own threats to the security memo. That ‘addition’ is later quoted as the reason for  using illegal means to investigate citizens deemed ‘terrorist’ by the previous law enacted by the same administration..because it said “… “individuals and organizations involved in global terrorism possessed the capability and intention to undertake further terrorist attacks within the United States,” and “that the president should authorize the NSA to conduct the surveillance activities.”

Not only did the White House make up it’s own CIA threat memo, but it then quoted that fable as the reason to authorize  the illegally wiretapping of Americans.

The question isn’t ‘are they guilty?”  The question is, why aren’t we investigating this?

When are we going to stop with the word salad of  “He didn’t lie, he just intended to ‘mislead’ you?”

When are we going to say.. “That’s it! enough already! At the very least you people need to answer questions on just exactly what the hell you were doing!

How can any party that claims to love the Democracy that we live in, stand by while a member of their party goes to such extremes to bypass every part of a democracy. If they are afraid of Socialism because of some healthcare for the poor and downtrodden, then where is the outrage of the power grab that went on unchecked for years? Is one man worth your support in the face of such crimes just because of the (R) next to his name?

At one time I was against any investigation into the Bush administration, I still believe it would be the biggest political mistake of President Obama’s career, but at what point do you just have to look at the American people and say “We can no longer deny this, we can no longer cover this, we can no longer allow this to happen.” and finally order a full scale investigation, that would lead to criminal proceedings if warranted. Yesterday the mistake may have been to go after an ex-President in a way that would cripple all future Presidents out of sheer ‘vindication’ and ‘retribution’ from a malicious political system.  But today, with more and more extremists views and the outright take over by a corrupt White House, the danger of not investigating far outweigh  any others.

How can we stand up as the beacon for democracy when we don’t even investigate those who tried to steal the democracy away from the American people under the guise of ’safety’ … a ’safety’ they are happy to tell you worked so well that we haven’t been attacked since 9/11/2001 (while omitting the part where they were to ones who were on watch when that attack took place to begin with), was bragged about being from numerous assertions that their excessive measures stopped multiple attacks. This,  has also been found to not only be misleading, but bordering on an out and out lie.

How do we go about calling this the greatest country on the planet when we allow a President to hide or even block  his illegal activities from his own Justice Department. A move which the IG reports calls “extraordinary and inappropriate”, so much so that the Attorney General, Deputy Attorney General,Director of the FBI and… more than a dozen officials at the highest levels of government became concerned that if the surveillance program was allowed to continue on as it had been, the government could be engaging in an illegal activity at the direction of the president, and they quietly spoke of resigning en masse.

How do we stand up to other countries where ‘coups’ have ousted members of the Government or forces within the Government have usurped the laws of  that country for their own benefit, when we allow the same thing to happen here? How do we condemn a madman for his ‘genocide’, but when presented with evidence of another mass murder we ignore it because the murderer happens to be on our side today, when he was against us and killing our servicemen yesterday?

The mainstream media is treated like a rape victim of the 1980’s…they are blamed for what they report.  They are called biased and unfair, slanted and ‘liberal’.. they are condemned  for reporting the news. Why are they castigated for telling us what was done to us, but the person doing it is enveloped into a protective shroud all because of his political color.

The ‘liberal’ slant to the media is always the reply to the story, like that somehow excuses the actual facts.  It’s become an ‘eye roll’ that says… “There goes the liberal press again, blaming Bush for an illegal program that Ashcroft, the FBI and members of the DOJ refused to endorse”… The fact this happened isn’t their focus,  the fact that it was reported is..

If the MSM is so liberal with it’s slant.. why isn’t  anyone talking about  the report from the Inspectors General of the CIA, Justice Department, Defense Department, National Security Agency and Office of the National Intelligence Director, on “Google Trends”?

The CIA not only admitted to misleading congress on some programs, but in one case  omitted telling them completely.. But the media and Nancy Pelosi are partisan and slanted for saying the CIA has lied to Congress?

If we cannot look at the facts and come to a logical conclusion all because it’s our own political party that erred.. then maybe it is time to end the Democracy as we know it and evolve into something else. We have  already had a President who usurps laws and governmental offices at his leisure,vilifies anyone who disagrees with him, tries to coerce those around him into doing his bidding and when unable to, conspires to go around them and get what he wants from someone else and then raises that someone to position of the person who originally denied him. Our democracy is already dead and we lived in  a Banana Republic that was run by a dictator and his army of thugs. But for me to tell you this makes me unpatriotic and the one who ignores real criminals like President Obama.

Introducing… Lil mike

I’d like to take a minute for this “Friday Rewind” to introduce my friend and politically polar opposite, Lil Mike. He has an amazing ability to argue his side of an argument and like me will go on for days on a single subject. At present time, we have logged over 10000 hrs(ok, that may be exaggerated a little) into the “Valerie Plame, Leak case” and I haven’t a single doubt that no two people on the planet,including those involved and the so called ‘experts’, are more well versed than we are when it comes to that subject(that’s not an exaggeration) . We both are abnormally addicted to current issues and researching them in order to prepare for the debate that will follow. There have been many topics that I had no knowledge of until Mike decided to bring them up for debate.. and then I was forced into learning the minutia of said topic in order to keep up with him.. as he has had to do with me…HA!

I can’t say that either of us have ever changed each others mind on any particular issue.. and given our politically polar opposites, that’s not a surprise… what is a surprise are the things we actually agree on. But those are so ‘eclectic’ that they can not be predicted… and that’s what makes it fun.

Mike is the best adversary I’ve ever come across. He can make me laugh,cry,wonder wtf planet he is from.. he can even anger me to the point of having to drown small animals just for the ‘release’.. but through it all, after 10 years we’ve been able to go from such extreme emotions on one topic, to another topic with not a single hard-feeling or ‘carry-over’. Each conversation is a clean-slate no matter how intense the last one, or in most cases, the current one is.

Some wag once said that Obama keeps all of his promises; they just have an expiration date.  I guess that’s how we got from “President Barack Obama will not pursue the prosecution of Bush-era officials who devised torture policy against detainees to it is going to be more of a decision for the attorney general” within a few days.  That was a quick turnaround, even by Obama standards.  However events and leftie blogs pushed Obama rather quickly after the release of the “torture memos,” which reveal the legal underpinning for what is euphemistically referred to as “enhanced interrogation.”

 

The timing strikes me as odd considering just a week ago a Spanish court decided to investigate whether to pursue charges against Bush administration officials who provided the legal underpinning for those interrogations.  Then low and behold, the Obama administration declassifies those very documents written by those Justice Department lawyers.  That could hardly be a coincidence.  The message seems to be that the Obama administration will not attempt to protect and may even assist, in international prosecutions of Bush administration officials, and who knows, maybe even prosecute a few themselves.

 

I took a look at the torture memos out of curiosity and to confirm that things people were saying were in there actually was.  I’ve learned you can’t trust someone else’s interpretation.  Full disclosure:  I didn’t read the whole thing.  I just don’t have the legal background to make a determination if the case the Justice Department attorneys tried to make made sense or not, but I was curious about a few things.

 

First of all, what was the classification of these damn things?  Looking at the pdf of the memo, I could see that the pages were all classified Top Secret (scribble scribble) NOFORN, but what was the caveat or code word that was scribbled out?  I magnified and tried to see through the blackened areas, but no such luck.  Just curious I guess.  I was just wondering if it was a cool sounding codeword, Top Secret Maximum Hammer, or just something dorky, Top Secret Loosie Goosie?

 

Another thing; what was the deal with all the waterboarding?  The original leaks described it as the most successful interrogation technique since “good cop, bad cop.”  Abu Zubaida supposedly broke after 35 seconds.  However page 37 of the memo details something more complicated:

…where authorized, it may be used for two “sessions” per day of up to two hours. During a session, water may be applied up to six times for ten seconds or longer (but never more than 40 seconds). In a 24-hour period, a detainee may be subjected to up to twelve minutes of water appliaction. See id. at 42.  Additionally, the waterboard may be used on as many as five days during a 30-day approval period.

…The CIA used the waterboard “at least 83 times during August 2002” in the interrogation of Zubaida…and 183 times during March 2003 in the interrogation of KSM”

 

So somebody check my math, but that that means either the guidelines for waterboarding are wrong, they ignored their own guidelines, or the number of waterboarding sessions is wrong, since the could not have waterboarded that many times in a month if they followed the guidelines.  Or they are counting applications, instead of sessions.  It’s too vague to tell.

 

As far as I know, I’m the first person to discover this, so somebody give a prize or something.

 

However I’m not the first person to notice the incongruity of it being reported that Zubaida broke after 35 seconds and being waterboarded 83 times in one month.  I don’t see how both of those can be true.

 

But like a 23 minute Arlo Guthrie song, that’s not what I’m here to talk about.  OK well maybe a little, but what I am really worried about is the Obama administration deciding to settle scores.  Since President Obama is the Attorney General’s boss, going from being not interested in pursuing prosecution of Bush era officials to saying it’s up to the Attorney General is tantamount to giving the green light to prosecute.

 

Now I am of two minds on this.  There is one part of me, the mean, hateful part, that would love to see lawyers have to take responsibility for writing legal opinions, and by taking responsibility I mean forced to pull their orange jumpsuits down in a dark corner of a federal prison and get doo doo raped.  I’m not a fan of lawyers as you might notice.  Generally, lawyers don’t have to take any responsibility for their poor performance. Their clients do. These lawyers, if prosecuted, certainly would.

 

Also there is the precedent.  Once one administration opens the door to prosecuting the previous administration for policies it disagreed with, every time there is a change in power, the new administration will do the same.  In 4 years I could sit back and watch members of the Obama administration be indicted for all manner of crimes.  What comes around goes around eh?

 

But that is only one side.  I have a more dominate opinion on this, not one based on score settling, hatred of the bar, or getting revenge on wrongs, real or otherwise, on the current administration at some point in the future, but based on reason, rule of law, and the dangers setting bad precedents.

 

 First of all, I’m not sure there is even a crime here.  There may be a crime somehow under Spanish law, but I’m fairly certain there is no Federal Statute against giving a legal opinion that the current administration disagrees with.  One can imagine the kangaroo courts if we decide it’s OK to prosecute judges for ruling on a decision that’s been overturned, or a legislator who votes for a law that is later found to be unconstitutional.  That would be as criminal as anything those Bush Justice Department attorneys did.

 

The precedent of one administration getting revenge on the previous one would be a bad one.  Senator Leahy’s idea of a truth and reconciliation commission; as if going from the Bush administration to the Obama one is equivalent to eliminating apartheid, or the Nuremberg Trials, is ridiculous.  During every election, we always like to repeat the old canard about “the peaceful exchange of power” but how long would that be true if we up the stakes every time  political parties switch positions of power?  If hundreds of administration officials could expect nothing but indictment if a rival party takes power, are we really not that far from Peron’s Argentina?

 

It’s one thing to indict and prosecute officials who have actually done criminal wrongdoing, but I’ve noticed from my friends on the left is their tendency to want to criminalize policy differences.   They would love to have Bush and Cheney doing the perp walk, weighed down with chains, but ask them what sort of charges its usually something vague, like “war crimes” or just that they were criminals.  Their real crimes?  Holding different policy positions.  Not violating federal statutes.  If we try to prosecute attorneys for writing legal opinions, that won’t be justice, it will be punishment.  Punishment for losing the election.

 

Once we cross that particular Rubicon, it’s damage that cannot be undone. Rome could never go back to it’s Republic, and if we allow score settling after every change of power, we won’t be able to go back either.

Torture; paybacks are a bitch..

There has been a lot in the news about torture over the last few months. Did the US torture? If so, who authorized it? Do we punish the persons who actually did the torture? Do we punish the ones who authorized it? These are all questions that in all likelihood will piss people on both sides off when they are answered.

The “Jack Bauer” scenario is the most prominent reason given for torture.

A  bomb is about to detonate in a heavily populated metropolitan area, a person who knows the whereabouts of this bomb and other details of the plan is captured and he is not talking.

Pop-quiz asshole! What do you do?

Both sides answering this question have valid opinions.  One side screams to torture them until they spill every ounce of information they have. The other side points to this and says “But you don’t know if the information  is real. They could just be telling you anything and while you are out on that Easter egg hunt trying to confirm the information, valuable time will be wasted.” They are the ones who want to use tried and true interrogation tactics in this scenario because they believe those tactics work and they also believe that a time of stress and crisis is when it’s most important to stick to our values.

I agree with both sides.

I guess I’m in the ‘if all else fails‘ camp.

Obviously ‘normal’ police method interrogation works. We’ve seen it’s success across the country on a daily, if not hourly basis. When people are caught for their crimes they want to talk, they want to explain,  they want you to understand why they did what they did but they need to be nudged into it.  That’s where a seasoned detective comes in.  If this type of ‘non-enhanced’ technique did not work, no one would ever confess… but they do.

But does torture work? Dick Cheney says it does. In fact he says that we actually faced a ‘Jack Bauer’ scenario and torture is what stopped this ’second wave’ from happening.  The Head of the FBI says this is untrue, The CIA says this is untrue, and others who have seen the memo’s Cheney is quoting  say this is untrue.  Dick Cheney has also heralded the capture of KSM as proof of tortures value. That has  also been called into  question by the actual interrogator.

Look, it’s not that you won’t get someone to talk by torturing them, I don’t think anyone is debating that point. It’s just that you will get them to talk about everything they think you want them to talk about, whether true or not.

Every example that Dick Cheney uses as his proof has since been found to be lacking in the ‘proof’ arena, and just like he now says Saddam didn’t have anything to do with 9/11.. maybe sometime in the future he’ll change this ‘torture worked’ storyline. Since it looks like he could be tried as a war criminal though, I doubt he’ll ever say that. What he will do is make sure everyone and anyone is aware that this was George W. Bush’s plan.  That’s also  turning out to be just another of Cheney’s fantasies though.

SCHIEFFER: … somewhere down the line. Did President Bush know everything you knew?

CHENEY: I certainly, yes,have every reason to believe he knew — he knew a great deal about the program. He basically authorized it.I mean,this was a presidential-level decision. And the decision went to the president. He signed off on it.

The problem I have with any of this “torture question”, is the hypocrisy of it. The,

“We don’t torture because we changed the definition of torture so we could torture legally”…

…is where I call foul. What made it ok for Jack Bauer to torture the terrorists in 24(besides the whole “it’s a TV show”), was the fact that he was willing to stand up to Congress and lay it all out on the table and take whatever punishment they doled out. That’s when, in my opinion, it’s ok to torture someone for information in the “ticking time-bomb scenario”.If you feel that what you are doing is not only right, but your duty as an American and you are so sure of this that you are willing to face the consequences afterward, then have at it and get all the information you can.

But just like lying about a blow job got a president impeached, lying about torture and your role in it should at least get you a public hearing.

It’s not the acts themselves that bother people, I would wager that if a “Jack Bauer” situation was being played out in real life an overwhelming majority of Americans would either turn a blind eye or slap the interroagtor on the wrist for their actions. But when you lie about, mislead others into believing your lie and then try and cover up your lie.. then the jury isn’t the only one who knows you were committing a crime.

Of course I will be ask …

“What if someone had your child, wouldn’t you torture them to find them?”

Yes… yes I would and if they harmed a hair on my child I would follow them home and cut them up into little pieces….slowly. But, when the police came to arrest me it would only take that seasoned detective about a minute to get me to talk. I would want tell him why did what I did. I would explain what I did to him and my subsequent jury. I would make them live through the horror  I and my missing/harmed child lived through and I would hope for  jury nullification.

Torture for the use of  gaining information, in my opinion is a crap shoot. It might work and it might not. The worst part about this ironically is the ‘ticking time-bomb scenario’. In that scenario there is no time for proper interrogations to be used, no time because the bomb is set to go off at any minute. Yet, there is time to investigate the false confessions which all agree are a part of the torture process? I don’t think so. If there is no time for mistakes then why chose the path which will ensure the most mistakes? It’s for this reason I am going more and more to the side of a “No Torture” policy for information gathering purposes.

That is not to say I am against torturing for punishment..

I will have to turn in my ‘liberal’ card for a month by saying this, but I think there are actual justifications to torture people, but in my world those reasons have to do with their crimes and not to get information out of them. Don’t believe there is a crime that the deserved punishment is some form of exquisite  pain upon the person guilty of the crime?

NEW ORLEANS —  Authorities say a 17-year-old teenager was charged with aggravated rape and first-degree murder of an 8-month-old child.

This is not a ‘redeemable’ child, this animal (because he is most definitely not a man or a human) who at the ripe old age of 17, already has convictions for  “drug possession charges; obscenity; battery on a correctional officer; three counts of battery on a school teacher; theft; weapons charges; and assault” in my opinion is worthy of a life of exquisite pain upon his conviction.

Not ‘torture-worthy’ enough?

CASSVILLE, Mo. —  The two men charged in rape and murder of 9-year-old Rowan Ford had their first brief court appearance Tuesday.

These men, one the child’s step-father, have been charged with ” first degree murder, sodomy and rape charges in connection to the death of Rowan Ford of Stella.” Whose body they just dumped in cave like a piece of garbage that they were done with using.

I  think they could to with a little ‘waterboarding’ just for the fun of it.

Torture for investigative purposes won’t give us the real-time intelligence we need in a ‘ticking time-bomb’ scenario.. but it will damn well make us feel better when we use it for the sole purpose of… ‘pay backs are  motherfucking bitch!’
